Terms of Service
Effective Date:
The terms that apply when you use the Aria Infotech website, the ARIA CRM platform and our software services. Please read them before you use our services.
1.Acceptance
These Terms of Service (“Terms”) are an agreement between you and Aria Infotech (“Aria Infotech”, “we”, “us” or “our”).
By using our website, signing up for the ARIA platform, starting a free trial or buying any of our services, you agree to these Terms. If you do not agree, please do not use our services.
If you accept these Terms for a company or other organisation, you confirm that you have the authority to do so. In that case “you” means that organisation.
If you have signed a separate agreement or order form with us, that document applies first wherever it differs from these Terms.
Changes to these Terms
We may update these Terms from time to time. The effective date at the top of the page shows the current version. If a change is significant, we will tell customers by email or in the platform before it takes effect. If you keep using our services after that date, you accept the updated Terms.
2.Eligibility
You may use our services only if:
- you are at least 18 years old and able to enter into a contract under Indian law;
- you are using the services for business purposes; and
- no law that applies to you prevents you from using them.
Our services are meant for businesses. They are not intended for children or for personal, household use.
3.Services
These Terms cover the following (together, the “Services”):
- This website, including the demo and free-trial request forms.
- The ARIA platform, a cloud-based (SaaS) CRM for real-estate brokerages. It includes lead and pipeline management, sales workspaces, call and messaging logs, hiring, attendance and finance tools, and AI-assisted features. See the features page for a full list.
- Professional services, where we agree to provide them: custom software development, AI development, web and mobile app development, enterprise software, and cloud and DevOps work. Each project is set out in a separate written agreement or statement of work.
Free trial
We may offer a free trial of the ARIA platform, currently 10 days. We do not charge for a trial. When it ends, access stops unless you choose a paid plan.
Changes and availability
We improve the Services regularly, so features may be added, changed or removed. We work to keep the platform available, but we do not promise that it will never be interrupted. We will try to give notice of planned maintenance. Any uptime commitment applies only if it is written in your order form.
AI-assisted features
AI features produce drafts and suggestions, such as call summaries, pitches and resume assessments. They can contain mistakes. You are responsible for reviewing AI output before you rely on it or send it to anyone.
4.User Responsibilities
Your account
- Give us accurate information and keep it up to date.
- Keep passwords confidential and give access only to people you authorise.
- Remove access for people who leave your organisation.
- Tell us at once if you suspect unauthorised use of your account.
You are responsible for everything done through your account.
Your data and your legal duties
You decide what data goes into the platform and how it is used. You are responsible for making sure that use is lawful. In particular, you must:
- have a lawful basis, and give any notice the law requires, before you upload personal data about your leads, buyers, job applicants or staff;
- tell people before their calls are recorded or transcribed, and get their consent where the law requires it;
- follow the Telecom Commercial Communications Customer Preference Regulations, 2018, including Do Not Disturb preferences, when you call or message leads;
- follow WhatsApp Business rules, including getting opt-in before you send messages;
- tell your staff about location-based attendance and use it only for attendance; and
- follow the terms of any property portal or advertising platform you connect.
Our Privacy Policy explains how we handle personal data on your behalf.
What you must not do
- Use the Services to break any law or to infringe anyone’s rights.
- Upload malware, or try to gain access you have not been given.
- Copy, resell, reverse engineer or build a competing product from the Services.
- Scrape the Services or place an unreasonable load on them.
- Send spam or unlawful marketing through the platform.
5.Intellectual Property
What we own
We own the ARIA platform, this website, our software, designs, documentation and brand, including the ARIA name and logo. These Terms give you a limited right to use the Services while your subscription is active. That right is not exclusive and cannot be transferred. These Terms do not give you ownership of any of our intellectual property.
What you own
You own the data you put into the platform. You give us permission to host, process and display it only as needed to provide the Services to you.
Custom development
For professional services, ownership of the work we deliver is set out in the project agreement. Unless that agreement says otherwise, we keep ownership of our existing tools, libraries and know-how, and you receive a licence to use them as part of the delivered work.
Feedback
If you send us suggestions, we may use them to improve the Services without owing you anything.
6.Payments
- Fees. The fees for your plan or project are set out in your order form, quote or statement of work. See our pricing page for the plans we offer.
- Taxes. Fees are in Indian rupees unless we agree otherwise. They do not include GST or other taxes, which we add to the invoice where they apply.
- Due date. Invoices are due by the date shown on them.
- Late payment. If a payment is overdue, we may suspend access after giving you written notice and a reasonable chance to pay.
- Renewal and price changes. Subscriptions renew for the period in your order form unless either of us gives notice before renewal. We will tell you in advance of any price change, which takes effect from your next renewal.
- Refunds. Refunds are handled as your order form provides, or as the law requires.
7.Limitation of Liability
We provide the Services with reasonable skill and care. Beyond what these Terms or your order form state, and as far as the law allows, the Services are provided “as is”, without any other warranty.
As far as the law allows:
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill;
- we are not liable for loss caused by third-party services you choose to connect, by your own use of data in breach of the law, or by your failure to keep your login details secure; and
- our total liability for all claims in any 12-month period is limited to the fees you paid us for the Services in that period.
Nothing in these Terms limits liability that cannot be limited under Indian law, including liability for fraud, or our duties under section 43A of the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
8.Indemnification
You agree to cover our losses and reasonable legal costs if a third party brings a claim against us because:
- you broke these Terms or the law;
- data you uploaded, or the way you used it, infringed someone’s rights; or
- you sent calls or messages through the platform without the consent or notice the law requires.
We will tell you promptly about any such claim, let you take part in the defence, and not settle it in a way that binds you without your agreement.
9.Termination
By you. You may stop using the Services at any time. To close an account, an administrator should write to info@ariainfotech.com. Fees already due remain payable.
By us. We may suspend or end your access if you seriously or repeatedly break these Terms, if payment stays overdue after notice, or if the law requires it. Where we reasonably can, we will give you notice and a chance to put things right first.
What happens next. When an account ends, your right to use the platform stops. You can ask for an export of your data within 30 days. After that we delete it as described in our Privacy Policy.
The sections on intellectual property, payments owed, limitation of liability, indemnification and governing law continue to apply after termination.
10.Governing Law
These Terms are governed by the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000.
If a dispute arises, please write to us first. Both sides will try in good faith to settle it within 30 days. If that fails, the dispute falls under the exclusive jurisdiction of the competent courts in India.
If a court finds any part of these Terms unenforceable, the rest still applies. If we do not enforce a right at once, we have not given it up.
